Heard learned counsel for the petitioner.

I do not find any sufficient ground to interfere to hold that the notification Annex.-3 is ultra-vires. The controversy, as to whether 'Bagaria' is Scheduled Caste or not, cannot be gone into in view of the fact that the notification is issued by the Parliament in accordance with the procedure prescribed in Part XIV of the Constitution, and inquiry in this regard is strictly prohibited by the series of judgment of Hon'ble the Supreme Court.

In view of the above, the writ petition is dismissed summarily.
