On 23.1.2007, both the parties submitted that the matter is likely to be compromised. Today, counsel for the petitioner submits that the petitioner is ready to compromise on the amount of Rs.67896/- in case the respondents waived the interest.
Counsel for the respondents submits that they are ready to waive the interest part on the said amount and is further ready to compromise the matter on the amount of Rs.67896/-.
The petitioner has already deposited the interest in the trial court. The compromise on the amount of
Rs.67896/- is accepted by both the parties and the same is verified. Accordingly, exparte judgment and decree dated 6.12.2004 (Annexure-10) is modified with a direction to refund the amount of interest to the petitioner.
The writ petition is disposed of in the light of the aforesaid compromise.
