By the order impugned, the learned Single Judge declined to recall the earlier order by which he had directed the Registry to place the writ petition before the Chief Justice for reference to the larger Bench. The dispute relates to pre-election disqualification for the office of Sarpanch of Gram Panchayat.
We do not think the order directing the
Registry to place the matter before the Chief Justice for reference to the larger Bench warranted recall. In any view the order does not decide rights of the parties. It may be mentioned that writ petitions have finally been heard and judgment is awaited in those cases.
