S.P.GUPTA v STATE OF RAJ & ANR - WRW Case No. 77 of 2005 RD-RJ 801 (8 February 2007)
D.B. Civil Review Petition No.77/2005
D.B. Civil Writ Petition No.945/2005 08.02.2007
Hon'ble Mrs. Gyan Sudha Misra,J.
Hon'ble Mr. K. C. Sharma, J.
Mr. S.P. Gupta, petitioner in person.
Mr. R.D. Rastogi, for the respondent-RSRTC
Mr. S.N. Gupta, Addl.G.A., for the State.
This is a petition for review of the order dated 25.5.2005 by which the writ petition was dismissed wherein the request of the petitioner to provide concession to the senior citizens even in A/c, deluxe and semi-deluxe buses has been rejected in view of the reply of the respondents that they are short of funds.
We do not see any legal ground to entertain this review petition as the relief claimed by the petitioner, which is to be provided by the respondent-
State, is purely an administrative discretion of the respondent-State and, therefore, it is not possible to hold that the impugned order requires to be reviewed.
However, considering the fact that the plea raised in the writ petition was not adversarial in nature and was filed admittedly to provide some relief to senior citizens, we deem it appropriate to dispose of this review petition with an expectation from the respondents RSRTC and the State Government to examine the matter on their own and make an attempt to provide the relief sought by the petitioner in this writ petition.
Accordingly, the review petition, stands disposed of. [K. C. Sharma],J. [Gyan Sudha
