SUMITRA DHAKAD v BALDEV PRASAD & ORS - CMA Case No. 1688 of 2006  RD-RJ 850 (12 February 2007)
Sumitra Dhakad Vs. Baldev Prasad & Ors.
Date of Order :: 12th February 2007.
HON'BLE MR. JUSTICE DINESH MAHESHWARI
Mr. Sandeep Sarupariya, for the appellant. ...
The Tribunal has awarded compensation in the sum of Rs.93,500/- to the claimant-appellant for the loss suffered by her due to the injuries sustained in accident that include fracture at right arm and when she has been certified carrying 25% permanent partial disablement. The Tribunal has taken note of all the facts of the case, the age of the appellant at about 50 years, the bills of treatment expenditure produced and the agony undergone and has allowed Rs.60,000/- in view of 25% permanent partial disablement, Rs.21,000/- towards treatment expenditure, Rs.5,000/- towards transportation, special diets and other miscellaneous expenses, and further
Rs.7,500/- towards loss of income for six months on notional basis.
In the overall analysis, the award made by the
Tribunal in the sum of Rs.93,500/- cannot be said to be falling short of just compensation admissible in this case and there appears no scope for enhancement.
This appeal by the claimant seeking enhancement remains bereft of substance and is, therefore, dismissed summarily.
