This revision petition is directed against the order dated 26.11.2005 of Addl. District & Sessions Judge (Fast Track) No.2,
Baikaner whereby he has discharged the respondents nos. 2 to 8 from the offence under Section 307 IPC and the case has been transferred to Chief Judicial Magistrate, Bikaner for further proceedings in accordance with law.
Heard learned counsel for the petitioner, learned Public
Prosecutor and learned counsel for the respondents nos. 2 to 8.
As per the order of the Addl. Sessions Judge, there are three injured persons, namely, Suraj, Ram Ratan and Nand
Kishore and the injuries suffered by Nand Kishore and Ram
Ratan are simple whereas one injury suffered by Suraj on the hand has been found to be grievous after X ray. There is thus no grievous injury on any vital part of any of the injured persons.
After hearing the learned counsels of the parties and after perusing the record as made available to me I find no error or illegality in the order of the learned Addl. Sessions Judge (Fast
Track) No.2, Bikaner. There is no ground for interference.
The revision petition, therefore, stands dismissed.
