Writ Petitions filed under Article 226 of the Constitution of India to issue writs of Mandamus, calling for records of the respondents ending with the order of the third respondent in Letter No. KKNA.2/3810/95 dated 16-10-2003; and Letter no. KKNA.2/4067/95 dated 16-10-2003 respectively and quash the same and directing the respondents to execute the sale deed in favour of the respective petitioner by considering the representation of the respective petitioner dated 2 6-2-2005 with respect to Flat No. S-19 in Luz Scheme, Mylapore, Chennai-4 without demanding any further amount. :COMMON ORDER
On direction, Mr. D. Veerasekaran takes notice for respondents 2 to 4.
Though the writ petitioners challenge the information
of the Executive
Engineer and Administrative Officer, K.K. Nagar Division, Tamil Nadu Housing
Board, Chennai-83 dated 16-10-2003,
it is not in dispute that they made
representations to the Managing Director, Tamil Nadu Housing Board on
26-2-2005
highlighting their stand and also praying for revising their
calculations as pointed out in the said representations. The
petitioners have
asserted that till date the 2nd respondent has not considered and passed
orders. In such a circumstance,
the second respondent, namely, Managing
Director, Tamil Nadu Housing Board, Anna Salai, Chennai-35 is directed to
consider
the representations of the petitioners dated 26-2-2005 and pass
orders in accordance with law within a period of six weeks
from the date of
receipt of a copy of this order. Writ Petitions are ordered accordingly. No
costs. Connected W.P.M.Ps., are
closed.
