JUDGMENT



(Judgment of the Court was delivered by P. SATHASIVAM, J.) The above writ appeal is directed against the order of the learned single Judge dated 22.07.2003 made in W.P.No.20241 of 2003, in and by which, the learned Judge has dismissed the writ petition.

2. Heard the learned counsel for the appellant as well as the learned Government Advocate for the respondents.

3. In the said writ petition, the petitioner sought to issue a writ of Mandamus directing the respondents to furnish certified copy of the Government Letter No.55846/M.e.4/92-18 M.A.W.S. Department dated 28.07.1994 to him. The learned single Judge, rightly pointing out that without impleading the person in whose favour the Government has passed the said order dated 28.07.1994, the petitioner is not entitled to the relief sought for, has dismissed the writ petition. We are in entire agreement with the said conclusion.

Apart from the same, the learned Government Advocate has brought to our notice the letter dated 22.01.2002 sent by Thiru H.Dhanaraj, I.A.S., Joint Secretary to Government, Municipal Administration and Water Supply Department, Secretariat, Chennai-9, wherein the petitioner/appellant was requested to send a certified copy of the instructions to the Government for verification. In the same letter, the Officer has requested the petitioner/appellant to indicate the subject matter of the letter in order to ascertain the same and comply with the request of him. If the petitioner is really interested, he is free to comply with the request or make a fresh application enclosing all the details to the persons/authority concerned.

5. With the above observation, the writ appeal is dismissed. No costs.
