Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus to direct respondents 1 to 4 herein to withdraw the recognition and affiliation accorded to the 5 to 9 respondents for imparting sub standard education to the students of B.Ed and D.T.Ed courses without any infrastructure and facilities prescribed by the NCTE, Southern Regional Committee, Bangalore and the norms prescribed by the Universities for granting affiliation. ( Order of the Court was made by P.SATHASIVAM, J.) The petitioners have approached this Court to issue a writ of mandamus directing respondents 1 to 4 to withdraw recognition and affiliation accorded to respondents 5 to 9 for imparting sub standard education to the students of B.Ed. and D.T.Ed courses without any infrastructure and facilities prescribed by the NCTE, Southern Regional Committee, Bangalore and the norms prescribed by the Universities for granting affiliation.

2. On direction, Mr.S.Udaya Kumar, learned Senior Central Government Standing Counsel takes notice for the first respondent.

3. We are not inclined to issue direction as claimed by the petitioners. However, it is brought to our notice that even as early as on 01.11.2006, the petitioners have mad e a representation highlighting similar grievance to several authorities including the first respondent. Though learned counsel appearing for the petitioners is not in a position to produce the acknowledgement card evidencing receipt of the said representation, she is in a position to produce proof from the postal authority that representation had been sent on 21.11.2006. Taking note of the above assertion, we direct the first respondent to dispose of the said representation in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. The petitioners are also permitted to forward a copy of the said representation along with the present order to the first respondent. With the above direction, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. gms
