ORDER

(Order of the Court was made by P.SATHASIVAM,J.) The petitioner has filed the above writ petition to issue a Writ of Mandamus directing the respondent-the Member Secretary, Chennai Metropolitan Development Authority, Chennai-600 008, to grant six months time for demolishing the 4th and 5th floors of the building situated at 3-A, Whennels Road, Egmore, Chennai-600 008.

2. On direction, Mr.Ravindran takes notice for the respondent.

3. It is not in dispute that the petitioner has exhausted all his remedies including the remedy before the Supreme Court, which has dismissed his Special Leave Petition No.17171 of 2006 on 02.11.2006. In those circumstances, the petitioner by stating that he is running a lodging house in the building in question, seeks six months time for demolition of the 4th and 5th floors by engaging a contractor on his own. In paragraph 2 (G) of the affidavit, the petitioner has undertook that he will complete the demolition work within the prescribed time by engaging a contractor on his own.

4. Taking note of the grievance expressed by the petitioner, we are inclined to grant further time of four months from today (20.01.2007) for demolishing 4th and 5th floors by engaging his own contractor. To this extent, the writ petition is ordered. No costs. Consequently, MP.No.1 of 2007 is closed.
