This writ petition has been filed against the impugned suspension order dated 17.4.2003.
Learned counsel for the petitioner has submitted that in the same enquiry another officer, namely, Shri B.P. Mishra, J.E. was also put under suspension and this Court vide order dated 23.5.2003 has stayed the operation of the suspension order. Thus in order to maintain uniformity, we should also stay the operation of the impugned suspension order.
However, Learned Standing Counsel has pointed out that to the Junior Engineer interim relief has been granted on the ground that he had been there only for a short period, i.e., less than two months, while in the case of the petitioner, he had been posted for more than a year in the relevant period, therefore, there cannot be any parity.
In view of the distinction pointed out by the Learned Standing Counsel and considering the nature and gravity of the charges, we are not inclined to interfere with the impugned order.
Petition is, accordingly, dismissed.
