This writ petition has been filed for seeking a limited relief as to whether the petitioner is entitled for the benefit claimed of the exemption under U.P. Agricultural Debt Relief Scheme, 1990, by which it has been provided that outstanding dues upto the tune of Rs.10000/- outstanding in 1989 shall not be recovered.
The petitioner submits that he has taken a loan of Rs.4,931/- on 1st February, 1989.
The respondents submitted a notice for recovery and petitioner has made a representation on 12th January, 1998 not to recover the said amount, rather to confer the benefit of the said Scheme of 1990.
As the representation has not yet been decided and still requires consideration by the respondent nos. 2 and 3, the petition stands disposed of with the direction to the respondent nos. 2, 3 and 4 not to recover any amount from the petitioner prior to deciding the representation submitted by him.
In case that representation is not accepted, the authorities are directed to pass a speaking and reasoned order and communicate the same to the petitioner.
