This writ petition has initially been filed challenging the election of the management committee held on 16.6.1999. As per the term of the clause (g) of the Scheme of Management the tenure of the duly elected committee is three years. During the pendency of this writ petition, term of the committee stood expired and a new committee of management has been elected on 4th June, 2002. It has been given recognition by the statutory authority vide order dated 17th June, 2002. Petitioners being aggrieved of the recognition to the newly elected management committee made a representation raising all their legal and factual grievances before the respondent no.1 which has not yet been disposed of.
Taking abundant caution petitioners have filed an application for amendment in this writ petition challenging the newly management committee. However, as their representation against the grant of recognition to the election of the newly elected management committee vide order dated 17th June, 2002 has not yet been disposed of by the learned respondent no.1, it is not desirable to entertain the application of amendment.
Thus, this writ petition is dismissed as having become infructuous and the application for amendment is also dismissed with the direction to the respondent no. 1 to dispose of the representation/objection filed by the petitioners against the order dated 17th June, 2002 granting the recognition to the newly elected management committee, within a period of 8 weeks from the date of filing the certified copy of this order before him, and if possible, after giving an opportunity of hearing to the parties concerned. It is needless to say that the party aggrieved by the order passed by the respondent no. 1 shall have a right to resort to further legal action.
With these observations the writ petition is disposed of finally.
