This writ petition has been filed challenging the order passed by respondent no. 1 in favour of respondent no. 2 on 26.9.1998 recognising him as a Manager of the Society which has not been impleaded as a party.
Heard the learned counsel for the petitioner and Shri Nurul Huda, learned Standing Counsel appearing for the respondents.
Be that as it may be, firstly, the writ petition is not maintainable for not impleading the Society, of which petitioner claims to be duly elected Manager under the Scheme of its administration. Secondly, even if the writ is maintainable, petitioner claims to have been duly elected as a Manager of the said Society on 28th March, 1998. He further claims that he had been elected for a period of 5 years. That period of 5 years is likely to expire on 27th March, 2003, i.e., in the next week. There is no interim relief passed in favour of the petitioner by this Court.
No interim order has been passed in favour of the petitioner. Therefore, no purpose would be served by entertaining this writ petition, which has become infructuous by efflux of time.
The writ petition is dismissed as having become infructuous.
