The case has been taken in the revised list.

The counsel for the petitioner was granted time to inform the Court whether the suit is pending or not. He is unable to inform.

In Para 3 of the stay application filed along with rejoinder-affidavit on 7.12.1984 it has been stated that the trial court is proceeding with the suit (No. 186 of 1982) and in case the proceedings of the trial court (Munsif, Pilibhit) are not stayed the petitioner shall suffer irreparable loss and injury.

No order was passed by this Court in this application and thus the same is pending.  The suit must have been proceeded and decided by now.

The writ petition is accordingly dismissed. No order as to costs. However, if suit is pending the counsel may seek instructions and move application for restoration within one month from today.
