This writ petition has been filed seeking relief of recounting of votes in the election of the office bearers of Prathmik Shikshak Sangh.
Learned Standing Counsel has raised preliminary objection why Association and State have been impleaded unnecessarily for making the writ maintainable. The matters are governed by the bye-laws of Uttar Pradesh Primary Teachers Sangh. The said bye-laws do not have any statutory character, and therefore, writ cannot be entertained.
Learned counsel for the petitioner could not satisfy us as to how the said bye-laws have statutory character and how the said writ petition can be entertained for such a relief.
Petition is dismissed with liberty to the petitioner to file a suit or approach any other appropriate forum.
