Civil Misc. Writ Petition No. 8934 of 2004
891325550 Ct. Janmed Singh Versus Union of India and others
Hon'ble Rakesh Tiwari,J.
Heard Colonel Ashok Kumar, counsel for the petitioner and Sri K.S. Shukla, Addl.Standing counsel appearing for the respondents.
The grievance of the counsel for the petitioner is that the statutory petition moved on 20th November, 2003 under Section 117 of the Border Security Force Act, 1968 pending before respondent no.2 has not yet been decided.
This petition has been filed for a direction to respondent no.2 to decide the statutory petition of the petitioner within a specified period as directed by this Court. Sri K.S. Shukla, Addl.Standing counsel appearing for the respondents has no objection to this prayer for deciding the statutory petition within a specified time.
For the reasons stated above, this petition is disposed of with a direction to respondent no.2 to decide the said statutory petition by a reasoned and speaking order in accordance with law within a period of three months from the date of production of a certified copy of this order.
No order as to cost.
