Heard counsel for the parties and perused the record.
The petitioner has challenged the impugned transfer order dated 24.2.2004 ( Annexure-1 to the writ petition) passed by respondent no.2 whereby he was transferred from Allahabad to Fatehpur.
The counsel for the petitioner submits that the mother of the petitioner is suffering from spondilytis and neuralgia and is being treated at Allahabad and also his daugther is getting education at Allahabad. He further submits that in these circumstances, the transfer order of the petitioner be stayed for a period of six months so that his mother may be treated properly and his daughter may complete her examination. The transfer order will adversely affect the studies of her daughter.
In the peculiar facts and circumstances of the case, the operation of the impugned order dated 24.2.2004 ( Annexure-1 to the writ petition) shall remain stayed till 15th May, 2004 provided he gives an undertaking in writing that he shall join at his transferred place of posting on or before 16th May, 2004.
With the aforesaid direction, the petition is disposed of. No order as to cost.
