Present writ petition has been filed against the order of Central Excise and Gold (Control), Appellate Tribunal, New Delhi (hereinafter referred to as "CEGAT") dated 25.01.2002. Against the aforesaid order, reference lies under section 35-H of the Act. Learned counsel for the petitioner submitted that reference no.26 of 2002 has been filed in this Court, which is still pending, against the same order of the Tribunal involving the same question, raised in the present writ petition. Since the petitioner is availed alternative remedy by way of reference, present writ petition is dismissed on the ground of alternative remedy.
Writ petition is accordingly, dismissed.
