The petitioner was an employee of the U.P. State Road Transport Corporation. He retired from service on 30.4.1999. Prior to his retirement, he had undergone medical treatment at Ursala Hospital, Kanpur on the recommendations having been made by the Respondent-Corporation itself. A bill amounting to Rs.14378.70 paise for such treatment was paid by the petitioner and was given to the Respondent-Corporation for reimbursement. Since the said amount has not been reimbursed, the petitioner has filed this writ petition praying for a direction that the payment of the said amount be made to him.

The contention of the petitioner is that as per the rules applicable, the petitioner is entitled to such payment specially when Service Manager, Central Workshop, U.P.State Road Transport Corporation has itself referred the case of the petitioner to Ursala Hospital,Kanpur.

I have heard learned counsel for the petitioner as well as Sri M.P.S.Niranjan, learned counsel appearing on behalf of the Corporation and have perused the record.

In the counter affidavit the respondents have not denied that the petitioner is not entitled to such reimbursement but has only stated that after approval, the voucher had been sent to the Headquarter for sanction of funds.

Since the petitioner had been referred to the Ursala Hospital for treatment by the Respondents themselves and it is not denied by the respondents that they are not liable for reimbursement of said amount which was incurred in the medical treatment of the petitioner, in my view this writ petition deserves to be allowed.

Sri M.P.S.Niranjan, learned counsel appearing on behalf of the Respondent, prayed that three months' time may be granted to the Respondents for making such reimbursement to the petitioner.

Accordingly, this writ petition stands allowed and a direction is issued to General Manager, U.P. State Road Transport Corporation, Central Workshop, Kanpur Nagar, Respondent no.2, to reimburse the payment of Rs.14378.70 paise spent by the petitioner towards medical treatment within a period of three months from the date of production of a certified copy of this order before him.
