This writ petition has been filed for seeking a large number of reliefs. However at this juncture, Shri T.P. Singh, learned Senior Counsel appearing for the petitioner submits that parking site has already been shifted to the alternative site for parking, as per the directions given by the respondents, and at this juncture, he is interested only for waiving the penalty imposed upon the petitioner to the tune of Rs.27,000/- for not shifting immediately.
Shri B.P.Singh, holding brief of Shri Tarun Verma, learned counsel appearing on behalf of respondents submits that petitioner has already shifted the parking site.
In view of the submission made by the learned counsel for the respondents, we dispose of this writ petition with the direction that in case petitioner has already shifted the site of the parking, and in case petitioner files an application for waiving the penalty imposed upon him along with a certified copy of this order before the competent authority within one week from today, his application shall be considered sympathetically, expeditiously within a period of three weeks thereafter. For a period of four weeks, no recovery shall be made in pursuance of the impugned recovery notice.
