Heard counsel for the parties and perused the record.

The petitioner has challenged the impugned transfer order dated 30.12.2003 passed by respondent no.2 whereby she was transferred from Hathras, Mahamayanagar to District Bulandshahar.

The counsel for the petitioner submits that the children of the petitioner are getting education in Hathras, Mahamayanagar and are in mid academic session and the transfer order of the petitioner will affect their studies. Hence, the transfer order be stayed up to 30th April, 2004.

In the peculiar facts and circumstances of the case, the operation of the impugned order dated 30.12.2003 shall remain stayed provided she gives an undertaking in writing within one week from today that she shall join at his transferred place of posting on 1st May, 2004.

With the aforesaid direction the petition is disposed of. No order as to cost.
