This petition has been filed by the Food Corporation of India against the order dated 22.10.97 and 26.4.1997 passed by the respondents no.1 and 2 respectively in proceedings u/s 21(8) of U.P.Act No. 13 of 1972 whereby the rent of the premises in dispute has been enhanced from Rs. 356/- to Rs 2358/- per month.
I have heard Sri J. Nagar learned counsel for the petitioner.
The Rent Control Eviction Officer and the appellate authority Addl. District Judge, Lalitpur after consideration of the material evidence on record have held that Rs. 2358/- would be reasonable rent considering fair market value of the property in tenancy of the petitioner. Learned counsel for the petitioner has not been able to point out any illegality in the order. The order passed by Court below are based on material evidence on record and do not warrant any interference by this Court, under Article 226 of the Constitution.
The petition lacks merit and is accordingly dismissed.
