Heard Sri Vinod Sinha, learned counsel for the petitioner and Sri Mohan Yadav, learned standing counsel for the respondents.  

On the request of learned counsel for the parties, the writ petition is disposed off finally at this stage under the High Court Rules.  

This writ petition has been filed by the petitioner with a prayer to issue a writ of mandamus commanding the respondents to appoint the petitioner as Assistant Teacher in pursuance of the Selection/Posting Letter dated 1.9.1992, (Annexure No.1 to the writ petition), issued by respondent no.3 to respondent no.1 wherein it has been directed to issue an appointment letter to the petitioner within a period of 10 days or within the extended period.

The connected writ petition No. 33331 of 1992 was filed on behalf of the Management challenging the validity of the U.P. Secondary Education Service Commission and Selection Board, 1982 and U.P. Service Commission and Selection Board (Amended) Ordinance, 1992, wherein an interim order dated 15.9.1992, "Until further orders of this court, appointment if any, shall be subject to the result of the writ petition." has been passed. This writ petition has been dismissed and the above said order along with any other interim orders has been vacated.

In view of the said facts and circumstances, the respondent no.1 is directed to issue an appointment letter to the petitioner forthwith in pursuance of the order dated 1.9.1992 passed by District Inspector of Schools, Bulandshahar, respondent no.3, on his being duly selected in accordance with law.  The petitioner shall be paid salary regularly, month to month by respondents 1 to 4 in accordance with law.  

With these directions, the writ petition is allowed.  No order as to costs.
