Heard Shri Haider Husain learned counsel for the petitioner, Shri V.K. Singh learned standing and learned counsel for the respondents.

Shri Haider Husain has submitted that one Sri Ranveer Singh Chahar had filed a Writ Petition No.13461 of 1999 for being appointed as lecturer by way of promotion from the post of L.T. grade, which was ultimately allowed by this Court vide Judgment and Order dated 16.4.2004. In consequence of which one Sri Chiranji Lal Chahar was promoted from C.T. grade to L.T. grade and in the resulting vacancy of Sri Chiranji lal Chahar, the petitioner was appointed in C.T. grade. Since the writ petition of Sri Ranveer Singh Chahar was allowed and he was appointed regularly on the post of lecturer all the resulting posts have been validly filled up by way of promotion. Since, the subsequent appointment of the petitioner was based on the vacancy created due to the promotion of Sri Ranveer Singh Chahar, no dispute is now left and the writ petition deserves to be allowed. Learned counsel for the respondents could not deny the factual and legal submission.  

Under the facts and circumstances of the case, the impugned order dated 1.1.1990 (annexure-11 to the writ petition) is quashed. Let a writ of certiorari be issued, and the services of the petitioner shall be considered for regularization on the post of L.T. grade, in accordance with law.

With the above said observations, the writ petition is disposed off finally. No order as to costs.
