Heard Shri K.D. Tiwari learned counsel for the petitioner, Sri R.B. Sahai learned counsel for respondent no.3-State Bank of India and the standing counsel on behalf of the respondents 1 & 2.
This writ petition is disposed of on the basis of mutual agreement between the counsels for the parties with the condition that the petitioner shall deposit Rs.50,000/- with respondent no.3 within a period of one month from today and thereafter deposit the remaining balance amount in six equal instalments payable on expiry of every three months. It is made clear that in case, the petitioner defaults in making the payments as per the aforesaid instalments, the bank-respondent no.3 shall be entitled to recover the full amount. Till the expiry of period of the instalments, the impugned recovery citation dated 15.3.2004 (annexure-1 to the writ petition) shall remain in abeyance.
Copy of this order shall be made available to the learned counsel for the petitioner within 24 hours on payment of usual charges.
