This writ petition has been filed for restraining the respondent nos. 4 and 5 from raising the construction of the school building on the plot no. 1575 where it is being constructed.
The grievance of the petitioner has been that the respondent no. 4 had purchased the land from her son from the funds of the Gram Sabha and is proceeding with the construction of the school building illegally in collusion with respondent no. 5, who is closely related to her.
There are no proper pleadings regarding the purchase of the land by the respondent no. 4 from her son or anybody else. Petitioner simply says land had been taken by respondent no. 4 from her son.
In absence of any pleading for purchase or not disclosing any amount of consideration there for, we are not inclined to enter into these controversies. Learned counsel for the petitioner is not able to satisfy us as what is the legal injury caused to the petitioner and how it becomes the subject matter of judicial review of this Court. It appears that petition has been filed by the petitioner to settle his political score with the respondent no. 4 without any justification.
We doubt the bona fide of the petitioner, hence we dismiss the petition.
