Heard counsel for the petitioner; Sri Suresh Singh Standing Counsel and perused the record.
The petitioner, posted as Homeopathic Compounder in the Department of Health of Nagar Nigam, Kanpur Nagar, had retired on 31.8.2002. From Annexures 3 to 5 to the writ petition it appears that the petitioner has not been paid his post retiral benefits, i.e. Gratuity, Pension, Provident Fund, Encashment, Group Insurance, Difference of 5th Pay Commission, Bonus and Arrears of D.A.
By means of this writ petition, the petitioner has sought for a writ in the nature of mandamus commanding the respondents to pay his post retiral benefits amounting to Rs. 2,06,375/- towards Gratuity, Pension, Provident Fund, Encashment, Group Insurance, Difference of 5th Pay Commission, Bonus and Arrears of D.A.
An ad-interim mandamus is issued to the respondents to pay the aforesaid amount of the petitioner within a period of six weeks from today or show cause by filing counter affidavit within the same period.
List this case immediately after expiry of the aforesaid period.
