Heard counsel for the petitioner and perused the record.
The petitioner has sought quashing of the impugned transfer order dated 26.7.2004 (Annexure 4 to the writ petition) passed by respondent no. 2.
The counsel for the petitioner has argued that since the impugned order of transfer of the petitioner has been passed during the mid-academic session it will adversely affect the studies of his daughter and son who are appearing in the High School Examination of this year. The counsel for the petitioner submits that the petitioner will join the place of his posting immediately after expiry of the academic session 2004-05 and till the examinations of his son and daughter appearing in the High School Examination of this year conducted by the Board of High School & Intermediate Education, U.P., Allahabad are over the operation of the impugned transfer order may be stayed.
The operation of the impugned transfer order dated 26.7.2004 shall remain in abeyance till 31.5.2004. Fresh order may be passed thereafter.
With the aforesaid directions, this writ petition is finally disposed of.
