This writ petition is directed against the order of Secretary, Excise, Anubhag-2, U.P., Lucknow dated 07.07.2004, by which revision filed by the petitioner has been dismissed on the ground that at the time of inspection on 23.10.2003 72 bottles of beer manufactured at Rajasthan was found illegally. The licence was suspended on 24.10.2003 and thereafter, after hearing to the petitioner, licence was cancelled on 07.11.2003. Against which petitioner filed revision, which has been rejected by the impugned order. It is submitted that the allegation that on 23.10.2003 72 bottles of beer manufactured at Rajasthan were found is wrong and collusive. This Court in the writ petition can not examine the question of fact. Excise Officer as well as Revisional authority have recorded a categorical finding that the fact that at the time of inspection 72 bottles of beer manufactured at Rajasthan was found without authority and on the basis of said material, licence was cancelled. I do not find any reason to interfere with the order of revisioinal authority.
In the result, writ petition fails and is accordingly, dismissed.
