Smt. Sukkho & Another v. Raghuvir Saran & Others - FIRST APPEAL FROM ORDER No. 701 of 2004 [2004] RD-AH 614 (23 August 2004)
|
Hon'ble V.M.Sahai, J
Hon'ble Mrs. Poonam Srivastava, J
We have heard Sri Y.S.Bohra learned counsel for the appellants.
In an accident which took place by Tata Sumo BL-2 CH 4604, the second driver Mukesh died. His father, mother and wife filed the claim petition which has been allowed by the tribunal and a total amount of Rs.4,17,500/- was awarded. The father and mother have been awarded compensation of Rs.50,000/- each whereas the widow has been awarded the balance amount.
Learned counsel for the appellant has urged that the father and mother were entitled to equal amount of compensation as was awarded to the wife.
In our opinion, the tribunal has rightly awarded Rs.50,000/- each to the parents of the deceased and balance of the amount to the widow of the deceased.
We do not find any illegality in the impugned order of the tribunal. This appeal is dismissed summarily under Order 41 Rule 11 C.P.C.
