By means of the present writ petition, the petitioner has sought a direction to the respondents not to create any artificial break in the services of the petitioner and to allow the petitioner to continue the work and also direction to regularize the services of the petitioner as Collection peon.
The writ petition was filed in 1999 and by order dated 4.10.99 four weeks time was allowed to standing counsel to file counter affidavit. No counter affidavit has been filed and by order dated 21.4.2003 six weeks further time was allowed to the learned Standing Counsel to file counter affidavit. The court has also observed that no further time will be granted. No counter affidavit has been filed till today.
The petitioner is working as seasonal collection Peon at Tahsil Harraiya,district Basti.. On apprehension that his services may be dispensed with, he filed the present writ petition. The petitioner has relied upon an order of this court dated 2.12.2002 passed in Writ Petition No.50872 of 2002 whereby this court has directed not to terminate the services of the seasonal collection peons till the next exercise of regularization is completed or during the pendency of the writ petition which ever is earlier. As no counter affidavit has been filed till today, this petition is disposed of with the direction that the services of the petitioner as seasonal collection peon will not be terminated and he will be given work as per requirement for this seasonal collection peon according to his seniority till such time, the next exercise of regularization for seasonal collection peon in Tahsil Harraiya,District Basti takes place.
