We have heard learned counsel for the petitioner, standing counsel for the respondents No. 1 & 3 and Sri D.K. Tripathi for the respondent No. 2.
According to the petitioner, she was placed at Serial No. 3 on the waiting list in the selections made by the Higher Education Service Commission for the post of lecturer in zoology for about 44 posts in various colleges. Further, it is the case of the petitioner that out of those 44 advertised posts, 5 posts have not been filled up as the candidates recommended for those posts have failed to join or refused to join. In these circumstances, the petitioner claims to have made a representation to the Director, Higher Education for placing the persons in the waiting list against those vacancies which could not be filled up.
It is, therefore, directed that the Director, Higher Education will examine the matter and will pass an order containing detailed reasons justifying the placement of the persons in the waiting list including the petitioner or justifying the refusal to make the placement as requested. The decision will be taken by the Director within one month of the date on which certified copy of this order along with a self-attested copy of this writ petition is presented before him by the petitioner.
This writ petition is disposed of as above.
