Annexure-3 is an appeal preferred by the petitioner to the Secretary, Technical Education Board, U.P., Lucknow. On the last occasion, there was some confusion between "Secretary, Technical Education , U.P. Government" and "Secretary, Technical Education Board". Under regulation 33, the appeal is to be decided by the Board and not by the Government. The above has been clarified by the G.O. dated 9th December 1999, wherein, it has been mentioned that the employees should send their appeal to the "Secretary, Technical Education Board" and not to the "Technical Education Secretary of U.P. Government". Annexure-3 i.e. the appeal of the petitioner, therefore, had been rightly addressed too the Secretary, Technical Education Board.

This writ petition is therefore finally disposed of with the direction that the Technical Education Board, U.P., Lucknow will take a reasoned decision on the appeal of the petitioner within one month of the date on which a certified copy of this order along with a self-attested copy of this writ petition is presented before the Secretary, Technical Education Board by the petitioner. This short time of one month is being granted because of the submission of the petitioner that if the petitioner's appeal is allowed, he will be able to exercise his option before 30th June 2005 for a higher age of retirement of 62 years. Therefore, the decision taken by the Technical Education Board will be communicated to the petitioner by Speed Post provided the petitioner encloses a self-addressed duly stamped envelope along with the certified copy of this order.
