This writ petition has been filed raising the grievance that the respondent authority are asking the persons at the time of filing the tenders to deposit the 10% earnest money over and above the amount prescribed in U.P. Financial Handbook Volume 5 Par-1 Schedule 19 Paragraph 307 (18) which provides only the 2% maximum as earnest money of the amount of contract.
Sri M.P.S. Niranjan, appears for respondent nos. 2 to 5 may take instructions and file the reply within two weeks as under what circumstances the 10% earnest money is being asked.
List the matter after two weeks i.e. on 18.5.2005. Meanwhile the respondents shall not insist upon deposit of earnest money more than that prescribed under the Rules.
Let a copy of this order be made available to the learned counsel for the petitioner on payment of usual charges within two days.
