Civil Misc. Writ Petition No. 36979 of 2005
Hon'ble Sushil Harkauli J.
Hon'ble G.P. Srivastva, J.
According to the petitioner, he has been selected by the Higher Education Service Commission/ Board for the post of Principal of a Degree College. He has been placed in the College of the respondent No. 3 by an order of the Director of Higher Education. However, the respondent No. 3 is a self-financed un-aided institution, which has been brought out of the purview of the commission and the management of the respondent No. 3 has expressed its inability to pay the salary scale which is due to the petitioner and for all these reasons, the petitioner has not been able to join as Principal of the respondent No. 3. The petitioner claims that he has made a representation to the respondent No. 2 for being placed in some other College pursuant to the selection, which is still pending.
In view of these averments, the respondent No. 2 may examine whether there is any other vacancy where the petitioner can be placed in view of the situation mentioned above and accordingly pass an order with reasons placing or refusing to place the petitioner in another College as the case may be within six weeks of the date on which a certified copy of this order along with a self-attested copy of this writ petition is presented before the respondent No. 2.
This writ petition is disposed of as above.
