Petitioner is claiming the deposit of amount of tax upto to 31.03.2004 by producing of receipt of deposit as also statement of Sri Puspen Satyarthi, Assistant Regional Transport Officer, Moradabad. In the proceedings before Ist Additional Chief Judicial Magistrate, Moradabad therein. Assistant Regional Transport Officer is said to have disputed the tax upto 31.03.2004. Learned Standing Counsel seriously disputing the factum of deposit.
We have heard Sri Rajesh Yadav,learned counsel for the petitioner and learned Standing Counsel and perused the writ petition and its annexures.
Counter and rejoinder affidavits have been filed by the respective parties as also certified copy of the statement of Sri Puspsen Satyardhi, Assistant Regional Transport Officer, produced before the Court, we are of the opinion as to whether petitioner has deposited the amount upto 31.03.2004 and more appropriate be gone into by taxation officer, petitioner is directed to produce all evidence regarding the deposit of the amount before the taxation officer, who shall verify the same from the same of its record and in case amount has already been deposited, seized vehicle shall be released.
With the aforesaid observation, writ petition is disposed of.
