In view of the fact that the recommendation of the District Magistrate dated 17.08.2002, which was the subject matter of challenge in the writ petition, was not subsequently accepted by the Indian Oil Corporation in the course of lesser penalty, in view of first instance of sample failure being dated 17.04.2003, which was challenged by a subsequent writ petition being Civil Misc. Writ Petition No. 17663 of 2003 and the petitioner lost therein and accepted the position. The present writ petition seems to be infructuous in nature and is dismissed as infructuous without imposing any costs. However, the order, which has been passed by the Division Bench of this Court being dated 19.05.2003 in Civil Misc. Writ Petition No. 17663 of 2003 and the report of India Oil Corporation dated 17.04.2003 will govern the petition.
