Writ petition challenges the transfer order of the petitioner dated 30th July 2003. The writ petition has been filed almost two years of the transfer order. We, therefore, decline to entertain the first prayer in the writ petition for quashing the impugned order.
However, the petitioner contents that he was not surplus and, therefore, was wrongly transferred. A representation by the petitioner in this behalf is said to be pending before the respondent No. 2. Because the question involved in the representation may effect the future service prospects of the petitioner, therefore, the representation may be decided to the limited extent of finding out whether the petitioner was or was not working on surplus post at the place from where he was transferred. The decision may be taken by the respondent No. 2 within two months of the date on which a certified copy of this order along with a self-attested copy of this writ petition is presented before the respondent No. 2.
This writ petition is disposed of as above.
