Heard learned counsel for the petitioner and learned A.G.A. as well as perused the record of the writ petition including first information report dated 6.1.2005(Annexure-1 to the writ petition) registered as case Crime No. 7/2005 State Vs. Rafal Singh under Section 420,467,468,471 IPC, P.S. Kutubsher, Saharanpur.
Considering the facts and circumstances of the case we are not inclined to exercise the power under Article 226 Constitution of India. During the investigation the petitioner will be at liberty to apply for bail before the Court below which shall consider the same in accordance with law and in the light of the case of Amarwati Vs. State of U.P. reported in 2004(57) A.L.R. page 389.
Writ Petition is disposed of finally subject to the above observations.
