Heard learned counsel for the petitioners and learned A.G.A. and perused the record of the petition in including the F.I.R. dated 04.01.2005 Annexure-1 to the petition, registered as case Crime No. 13 of 2005 under Section 498A, 323 , 506 IPC and Section ¾ D. P. Act, P. S.  Kotwali, District Muzaffar Nagar. Prima facie the offence is made out. No case for interference in the first information report is made out.

The petitioner id at liberty to apply for bail before the Court below which shall consider the same in the light of the decision in the case of Amarawati Vs. State of U.P. reported in 2004(57) A.L. R 389.

The Writ petition is finally disposed of subject to the observations made above.
