Heard learned counsel for the petitioner and learned Standing Counsel appearing for respondent nos. 2 & 3.
It is not in dispute that the petitioner has filed Civil Revision No. 226 of 2005 before the District Judge Basti, which is pending and 01.07.2005 is fixed for disposal of the stay application (paper No. 5C-2. The contention of the learned counsel for the petitioner is that in case of non disposal of the stay application on the date fixed he is likely to suffer irreparable loss. In the circumstances it is provided that the stay application (paper no. 5 C) shall be heard and decided by the District Judge on the date fixed after hearing the learned counsel for the parties in accordance with law subject to other business of court. Till 01.07.2005, it is provided that the respondents shall not interfere in the running of the liquor shop of the petitioner situated at Manikchand Chauraha, Basti.
It is made clear that the Trial Court will proceed to decide the interim injunction application uninfluenced by the protection, provided by this Court which has been made only to meet out the immediate exigency and this Court has not examined the merits.
With these observations the writ petition is disposed of.
