The petitioner will not be retired from service till the next listing provided he furnishes an undertaking within ten days before his appointing authority that if the writ petition fails, the petitioner will refund the entire amount of salary and other emoluments for the period after the date on which the petitioner attains the age of 58 years. This interim order will continue till the petitioner attains the age of 60 years or till the next listing, whichever is earlier.
Sri M.M.D. Agrawal may furnish two separate lists of cases of employees of Jal Nigam involving the age of retirement which are within his knowledge, one relating to the cases cognizable by Division Bench and the other relating to the cases cognizable by single Judge, to the Joint Registrar (Listing), who will make a bunch of such cases and list them together before the appropriate Benches.
Counter affidavit does not appear to be necessary individually in each case. The cases will be listed as a bunch in the cause list to be sent for printing on the date following the date on which the list is given by Sri Agrawal to the Joint Registrar (Listing).
