According to the petitioner, he has sought voluntary retirement about one year ago. The request of voluntary retirement is still pending. According to the averments of the petitioner, there are no disciplinary proceedings pending or contemplated against him and there appears to be no legal impediment to the consideration of the petitioner's request for voluntary retirement. It is alleged by the petitioner that instead of considering the request for voluntary retirement which has been pending for the past one year, the respondents have transferred the petitioner from Aligarh to Kanpur by the impugned order dated 10th June 2005..
In the circumstances, counter affidavit may be filed by the standing counsel within six weeks. List thereafter.
In the meantime, the petitioner will not be compelled to abide by the transfer order dated 10th June 2005, annexure -7 to this writ petition, until and unless his request of voluntary retirement is considered by the respondent No. 1 and the result of such consideration is communicated to the petitioner. The petitioner will be allowed to work at Aligarh unless the post occupied by the petitioner had been filled up by some other candidate.
