The land of the petitioner was acquired sometime in the year 1985 under the Land Acquisition Act. The award was also given on 31.3.1987. According to the petitioner he has filed an application under section 18 of the Land Acquisition Act on 24.4.1987 and as it has not been decided he has filed the present writ petition.
We have heard counsel for the petitioner and standing counsel and Sri Anurak Khanna for the respondent. The counter affidavit has been filed in which it has been alleged that the possession for the land has already been taken and the petitioner has accepted the award in the year 1987. It has been also further been alleged that no application to refer the case was filed. The writ petition itself was filed in the year 2002. There is also no rejoinder affidavit. There is no justification to disbelieve the assertion made in the counter affidavit. The writ petition has no merit. It is dismissed.
