The petitioner has been suspended in contemplation of a departmental enquiry by the impugned order dated 29.6.2005. A charge sheet of the same date has already been given to the petitioner. According to the petitioner, he is not guilty of these charges.
Having examined the charge sheet, we are of the opinion that this matter should be examined by the Enquiry Officer first and this Court should not upon itself the task of the Enquiry Officer to record findings of fact about the guilt or otherwise of the petitioner. Therefore, the writ petition is finally disposed of with the direction to the respondent No. 3 to get the departmental enquiry concluded within three months of the date on which certified copy of this order is presented before the respondent No. 3 by the petitioner.
