The selection of the respondent No. 6 as a doctor on contract has been challenged by the petitioner, who was also a candidate and who has not been selected on the following three grounds:
(1)that the domicile certificate of the respondent No. 6 was not enclosed with the application form and it was wrongly accepted subsequently by the Selection Committee;
(2)the domicile certificate which has been subsequently accepted is forged or fabricated or incorrect and the respondent No. 6 is not a domicile of Etawah district; and
(3)the respondent No. 6 was never interviewed by the Selection Committee like other candidates and she has been selected without any interview.
A representation to this effect has been made by the petitioner to the District Magistrate, Etawah, copy of the said representation dated 20.6.2005 is enclosed as annexure-7 to this writ petition.
Because pure questions of fact are involved, therefore, we require the District Magistrate-respondent No. 1 to enquire into the three allegations of the petitioner and thereafter pass reasoned order in respect of each of the three points above. Before passing the order, the District Magistrate will give an opportunity of hearing to the respondent No. 6 also. The decision will be taken by the District Magistrate within six weeks of the date on which certified copy of this order along with a fresh copy of the representation is submitted before the District Magistrate.
The writ petition is disposed of as above.
