Heard Sri Irfan Chaudhary, Advocate on behalf of petitioner and learned Standing Counsel on behalf of respondent nos. 1 to 4.
The petitioner, Mange Khan, who was appointed as Seasonal Collection Peon, seeks a writ of mandamus directing the respondents to offer seasonal work to the petitioner, strictly, in accordance with the seniority of the seasonal collection peon working in District Muzaffarnagar. It is pointed out that w.e.f. 22.8.2005 seasonal work has been refused to the petitioner while person junior to the petitioner are being offered such seasonal work. The petitioner in that regard has made a detailed representation before the authority concerned, which has gone unattended. Hence the present writ petition.
In the facts and circumstances of the case it would be in the interest of justice, if the petitioner is permitted to make a fresh detailed representation along with a certified copy of this order, ventilating all his grievances before the District Magistrate/Collector, Muzaffarnagar (respondent no.2) within two weeks from today. On such representation being made the District Magistrate (respondent no.2) shall consider and decide the same, strictly in accordance with law, preferably, within four weeks from the date the representation is so made. The District Magistrate (respondent no.2) shall pass a reasoned speaking order.
This Court has no room to doubt that the seasonal work shall offered to the seasonal collection peons strictly in accordance with the seniority maintained for the said purpose.
With the aforesaid directions the writ petition is disposed of finally.
