Heard Sri B.D.Mandhyan, Senior Advocate assisted by Sri Satish Mandhyan, Advocate along with Sri Madhomani Tripathi, Advocate on behalf of applicant/petitioner on the application with prayer to withdraw writ petition along with affidavit of Smt. Kirti Devi sworn on 8-8-2005 and filed today in Court. Smt. Kirti Devi has appeared before the Court in person and stated that the fact mentioned in her abovementioned affidavit have been made voluntarily without coercion or any threat.
In this context we may refer to earlier Application No. 129715 of 2005, purported to have been filed by aforesaid Smt. Kirti Devi/petitioner through Sri S.C. Mandhyan, Advocate (said to have been sworn on 24-5-2005 before Sri P.N. Dubey, Advocate/Notary, Kaptanganj). On the first page of said notarial affidavit we find coloured photograph of said Smt. Kirti Devi, deponent-petitioner in the present writ petition.
In the said application Smt. Kirti Devi had, however, prayed for rejecting earlier Application No. 111156 of 2005 filed through Sri Vidhu Bhushan Singh, Advocate. This Application No. 111156 of 2005 is also supported by an affidavit of said Smt. Kirti Devi (sworn on 15-5-2005). Smt. Kirti Devi has stated before us that she does not want to press said Application No. 111156 of 2005 filed through Sri Bidhu Bhushan Singh, Advocate in view of her subsequent present Application No. 155928 of 2005.
In that view of the matter, Civil Misc. Application No. 111156 of 2005 is rejected as not pressed.
In view of the above, subsequent Application NO. 129715 of 2005 also rendered infructuous and accordingly rejected.
None of the counsels representing the petitioner as well as the petitioner (who is present in Court) have any objection in the present application being allowed. Sri A.B. Saran, Senior Advocate assisted by Sri Parmatma Rai, Advocate has no objection in the present application being allowed.
In that view of the matter, present application is allowed as prayed.
Writ Petition stands dismissed as withdrawn.
No order as to costs.
