We Have heard learned counsel for the petitioner and the learned counsel appearing for the caveator.
The order dated 29.7.2005, annexure-2 to this writ petition mentions that the respondent No. 4 should be posted because of an undated letter of a Member of the Legislative Council. This tendency on part of the government servants to indulge in this kind of political manipulations must be discouraged in the strongest possible terms. Therefore, we overrule the objection of the respondent No. 4, who has appeared on the strength of a caveator that he has already joined pursuant to the order dated 29th July 2005 and the consequent order dated 2nd August 2005. We stay both the orders and direct that status quo ante as prevailing on the day immediately before 29th July 2005 with regard to the posting of the petitioner and the respondent No. 4 shall be restored forthwith.
A counter affidavit may be filed by the respondent No. 4 as well as the standing counsel within a month.
